1. Agreement & Binding Contract
These Terms & Conditions ("Terms", "Agreement") constitute a legally binding contract between you ("Client", "User", "You") and B Credit ("BCredit", "Firm", "We", "Us"). By accessing our portal (bcredit.in), subscribing to an advisory plan, submitting an application token, or utilizing any of our advisory services, you unreservedly agree to be bound by these Terms.
If you do not agree with these Terms in their entirety, you must immediately discontinue use of our platform and refrain from submitting any advisory requests.
2. Scope of Advisory & Dispute Resolution Services
BCredit operates as an independent credit health advisory and consumer dispute advocacy consultancy. Our services include:
- In-depth multi-bureau credit audit identifying reporting inconsistencies, Days Past Due (DPD) inaccuracies, fraudulent loan entries, and duplicate inquiries across CIBIL, Experian, Equifax, and CRIF High Mark.
- Statutory dispute representation and drafting formal dispute petitions under the provisions of the Credit Information Companies (Regulation) Act, 2005 (CICRA) and RBI Ombudsman guidelines.
- Liaison assistance with lending institutions (banks, NBFCs) for obtaining accurate settlement closures, No Objection Certificates (NOC), and No Dues Certificates (NDC).
- Personalized credit discipline coaching, credit utilization restructuring, and long-term financial health guidance.
3. Statutory Clarifications & Disclaimers
To ensure complete transparency and prevent misunderstanding, the Client acknowledges and agrees to the following vital disclaimers:
- Independent Advisory Entity: BCredit is an independent consultancy and is NOT a credit information company (bureau), bank, NBFC, or regulatory authority.
- No Unlawful Alteration of Accurate Records: Legitimate, factual, and verified defaults cannot and will not be erased through backdoor or unlawful means. BCredit works exclusively within statutory legal mechanisms to challenge wrongful, obsolete, erroneous, or unverified negative listings.
- No Guarantee of Score Magnitude: Credit bureau algorithms are proprietary to TransUnion CIBIL, Experian, Equifax, and CRIF. While BCredit utilizes proven legal methods to rectify erroneous entries, the exact numerical increase in credit score depends on external bureau mathematical formulas and overall credit behavior.
- Turnaround Timelines: Under Section 21 of CICRA 2005, credit institutions and bureaus have up to 30 to 45 business days to verify and respond to dispute filings. Turnaround times may extend depending on bank internal record audits.
4. Client Obligations & Representations
As a client engaging BCredit, you represent, warrant, and covenant that:
- All personal, financial, and KYC details furnished by you are true, accurate, current, and complete in all respects.
- You are the lawful holder of the PAN card and identity documents provided, or have lawful power of attorney to represent the account holder.
- You will promptly provide necessary supporting documents (bank statements, payment challans, settlement letters) requested by case officers to facilitate dispute representation.
- You will not simultaneously initiate conflicting third-party dispute filings that disrupt ongoing bureau reconciliation proceedings.
- You understand that failure to pay legitimate ongoing loan EMIs during the advisory period will negatively impact your credit profile independently of our dispute work.
5. Payment Terms & Fee Structure
Advisory fees are clearly detailed on our Plans page and during checkout. All payments must be remitted through official authorized channels (Razorpay, UPI, Net Banking, or verified institutional bank transfers). BCredit will issue an official GST-compliant tax invoice upon successful confirmation of payment.
6. Confidentiality & Non-Disclosure
Both parties agree to treat all communications, dispute filings, financial statements, and advisory strategies as strictly confidential. BCredit shall not disclose client details except to relevant credit institutions, bureaus, or statutory regulators as necessary to perform the services.
7. Limitation of Liability
To the maximum extent permitted by applicable Indian law, BCredit, its directors, analysts, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages arising from:
- A bank or credit bureau's administrative delay or statutory refusal to rectify verified default accounts.
- Client's submission of forged, fraudulent, or inaccurate payment proofs or KYC credentials.
- Adverse credit decisions (such as loan or credit card rejections) made by independent commercial lenders.
In all events, BCredit's total aggregate liability under any cause of action shall be strictly limited to the advisory fee actually received by BCredit from the Client for the specific service in dispute.
8. Termination of Advisory Service
Either party may terminate the advisory mandate upon written notice. BCredit reserves the right to terminate services immediately if the Client engages in abusive conduct, submits fraudulent documents, or violates statutory regulations.
9. Governing Law & Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any disputes, claims, or legal actions arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts in India.
